1. SERVICES AND SCOPE

Allbuild Construction LLC provides residential remodeling and general contracting services in the North Houston, Texas area, including but not limited to:

• Kitchen and bathroom remodeling
• Room additions
• Flooring installation
• Roofing and exterior work
• Interior renovations
• Custom carpentry and finish work

All services are performed in accordance with applicable Texas construction laws, building codes, and local ordinances in Harris County and Montgomery County, Texas.

2. AI-POWERED COMMUNICATIONS DISCLOSURE (TRAIGA COMPLIANCE)

IMPORTANT: As of January 1, 2026, Allbuild Construction LLC uses artificial intelligence technology to assist with communications and customer service in compliance with the Texas Responsible AI Governance Act (TRAIGA).

2.1 AI Systems Used

We use Anthropic Claude AI to:
– Respond to initial inquiries via SMS text message and email
– Triage customer requests
– Schedule initial consultations
– Answer frequently asked questions
– Generate follow-up communications through our automation platform (Make.com)

2.2 AI-Generated Communications Disclosure

When you receive a communication from us, particularly via SMS or automated email, it may be generated, drafted, or reviewed by artificial intelligence. These AI-generated responses are:
– Designed to be helpful and accurate
– Monitored for quality and compliance
– Subject to human review before deployment in critical matters
– Used for efficiency and to ensure consistent service

2.3 Your Rights

You have the right to:
– Request human interaction for any communication
– Opt out of automated communications by replying STOP to SMS messages
– Request clarification or escalation to a human team member at any time
– Be informed when AI has made an automated decision affecting your services

2.4 TRAIGA Violations

Violations of this disclosure or the TRAIGA statute (Texas Business & Commerce Code section 64.104) may result in liability of up to $200,000 per violation. We take AI governance seriously and maintain comprehensive records of all AI-assisted communications.

3. SMS AND COMMUNICATIONS CONSENT

3.1 TCPA and Texas SB 140 Compliance

By providing your phone number or consenting to SMS communications, you:
– Consent to receive text messages from Allbuild Construction LLC
– Acknowledge that standard message and data rates may apply
– Agree that this is not a condition of purchasing any goods or services
– Understand you can opt out at any time by replying STOP

3.2 Message Types

SMS communications may include appointment confirmations and reminders, project updates, invoice notifications, service inquiries and responses, and estimates and proposals (with consent).

3.3 No Marketing Without Consent

We will not send marketing, promotional, or advertising text messages without your explicit prior consent.

3.4 Opt-Out

To stop receiving SMS messages, reply STOP to any message. You will receive one confirmation SMS, then no further messages. To resume communications, reply RESUME.

4. ESTIMATES AND CONTRACTS

4.1 Estimates are Non-Binding

All estimates, quotations, or proposals are non-binding ballpark figures only. Estimates are valid for 30 days from the date of issue unless otherwise stated. Price may change based on site conditions discovered during project commencement.

4.2 Written Contract Required

Per Texas Property Code section 53.006, no project shall commence without a written contract signed by both parties. All contracts must include scope of work, total contract price, payment schedule, start and completion dates, change order procedures, warranty terms, and dispute resolution procedures.

5. PAYMENTS AND INVOICING

5.1 Accepted Payment Methods

Credit card via Stripe (Visa, Mastercard, American Express, Discover), check or money order, ACH bank transfer, or other methods as agreed in writing.

5.2 Payment Schedule

Payment terms are specified in the written contract and may include a deposit upon signing (typically 30-50%), progress payments based on milestones, and final payment upon completion and inspection.

5.3 Late Fees

A late fee of 1.5% per month (18% annually) or the maximum rate allowed by Texas law will be charged on overdue balances.

6. LIENS AND LEGAL NOTICES

Allbuild Construction LLC and any subcontractors retain all rights under Texas Property Code section 53.001 et seq., including the right to file a mechanic lien against your property if payment is not received. Texas Property Code section 41.001 and 53.006 provide homestead protections which are preserved under this agreement.

7. LIMITATION OF LIABILITY

NEITHER PARTY SHALL BE LIABLE FOR DIRECT DAMAGES EXCEEDING THE TOTAL AMOUNT PAID OR PAYABLE UNDER THE CONTRACT FOR THE SPECIFIC PROJECT IN DISPUTE. Neither party shall be liable for indirect, incidental, consequential, or punitive damages.

8. INDEMNIFICATION

Allbuild agrees to indemnify and hold harmless the property owner from claims caused by our negligence or willful misconduct. The property owner agrees to indemnify Allbuild from claims arising from misrepresentation of site conditions or failure to disclose hazardous materials.

9. INTELLECTUAL PROPERTY

All designs, plans, and specifications created by Allbuild remain our exclusive property until final payment in full, at which point they become yours for use on the project property.

10. FORCE MAJEURE

Neither party shall be liable for failure to perform due to events beyond reasonable control, including acts of God, pandemics, supply chain disruptions, permit delays, or utility failures. If a force majeure event prevents performance for more than 90 days, either party may terminate with written notice.

11. DISPUTE RESOLUTION

Before filing a lawsuit, both parties agree to attempt resolution through mediation in Harris County or Montgomery County, Texas. If mediation fails, venue is exclusively in Harris County or Montgomery County District Courts. Texas law governs. The prevailing party may recover reasonable attorney fees.

12. SEVERABILITY

If any provision is found invalid, it shall be modified to the minimum extent necessary. All other provisions remain in full force.

13. WAIVER

Failure to enforce any provision does not constitute waiver. Any waiver must be in writing.

14. ENTIRE AGREEMENT

This agreement, together with the written contract for your specific project, constitutes the entire agreement and supersedes all prior negotiations, representations, and discussions.

15. CHANGES TO TERMS

Allbuild reserves the right to modify these Terms at any time. Changes become effective upon posting to our website or upon email notification.

16. NO CLASS ACTION WAIVER

You agree that any dispute shall be brought in your individual capacity, not as a plaintiff or class member in any class action.

17. SUBCONTRACTOR DISCLOSURE

Allbuild may engage licensed subcontractors for specialized trades. All subcontractors must hold valid Texas licenses and carry required liability insurance.

18. WARRANTY

Allbuild warrants all work will be performed in a professional manner, free from defects in workmanship for 12 months from substantial completion. This warranty does not cover owner modifications, pre-existing conditions, natural disasters, normal wear and tear, or materials (manufacturer warranties apply separately).

19. CANCELLATION AND TERMINATION

Cancellation fees apply based on timing: more than 30 days before start (10%), 15-30 days (25%), less than 15 days (50%), after work started (all work performed plus profit on remaining). Allbuild may stop work if payment is 15 days overdue or site conditions become unsafe.

21. GOVERNING LAW

These Terms are governed by the laws of the State of Texas. The parties consent to the jurisdiction of Harris County and Montgomery County District Courts.

22. ACKNOWLEDGMENT

By engaging Allbuild Construction LLC for services, you acknowledge that:

• You have read and understood these Terms and Conditions
• You agree to be bound by all provisions

• You understand estimates are non-binding

5. THIRD-PARTY SERVICE PROVIDERS

SMS communications comply with the TCPA, Texas SB 140, and FCC regulations. Expected frequency: 2-10 messages per month during active projects. To opt out, reply STOP to any message. Your phone number will not be shared with marketing companies.

8. DATA RETENTION

Project records: duration of project plus 7 years (per Texas Property Code). Financial records: 7 years minimum. Communication records: duration of project plus 3 years. You may request deletion at any time, subject to legal retention requirements.

9. TEXAS DATA PRIVACY AND SECURITY ACT (TDPSA) RIGHTS

As a Texas resident, you have the right to: know what personal information we collect, access a copy in portable format, correct inaccurate information, request deletion (subject to exceptions), opt out of profiling, and appeal any denied request. 10. CHILDREN’S PRIVACY

We do not knowingly collect personal information from children under 13. If we become aware of such collection, we will delete it immediately.

11. DATA SECURITY

We implement encryption (HTTPS/SSL), secure passwords, limited access, regular audits, and secure deletion. All payment processing occurs through Stripe encrypted servers. No system is 100% secure; contact us immediately if you believe your information has been compromised.
